Employment measures for certain companies receiving direct aid

What Royal Decree-Law 25/2026 changes and what a company should check before a sensitive employment decision.

Published: 30 September 2026 · Effective: 1 October 2026 · Primary source: BOE.

What changes and until when

Until 31 December 2026, Article 36 of Royal Decree-Law 25/2026 prevents certain companies receiving direct aid from dismissing workers for force majeure or economic, technical, organisational or production reasons arising from the situation addressed by the law.

Who may be affected

It does not apply to every company or every dismissal. The company must have received one of the specified forms of direct aid, and the reason for the decision must have the connection required by the law. For permanent seasonal contracts, the article also addresses ending an activity period or failing to call a worker back.

A breach may require repayment of the aid and result in the dismissal being treated as null. Its application needs to be checked against the official wording and the facts.
