Permanent disability in Spain can affect both your benefit and your job. Review both.
The Social Security system recognises different grades of permanent incapacity. The employment consequences also need to be reviewed, especially under the changes introduced in 2025.
The grade, the decision date and the employment consequences should be reviewed from the actual resolution.
Partial permanent incapacity
A relevant reduction in performance for the usual occupation without preventing its fundamental tasks.
Total permanent incapacity
Prevents the worker from performing the usual occupation, while another occupation may remain possible.
Absolute permanent incapacity
Prevents the worker from carrying out any profession or occupation.
Severe incapacity
Applies where the person needs assistance from another person for essential acts of daily life.
A permanent-incapacity decision does not automatically mean the employment contract ends.
Law 2/2025 changed the Workers’ Statute so that, in certain cases involving total, absolute or severe permanent incapacity, termination is no longer automatic. The process is linked to the worker’s wishes and to whether reasonable workplace adjustments or a compatible vacant position are possible.
The worker has 10 calendar days from notification of the relevant decision to state in writing that they wish to continue the employment relationship. The employer has up to three months to make the reasonable adjustments or change of post, or, where the legal conditions are met, to adopt a reasoned termination.
The grade is only one part of the picture.

- The exact Social Security or INSS decision.
- The grade recognised and the benefit framework that follows from it.
- The notification date.
- Possible workplace adjustments or a compatible alternative position.
- Any subsequent communication from the employer.
